DCM Legal Privacy Policy

DCM Legal (the “Firm”) provides legal and policy consulting services. This Privacy Policy explains our practices regarding the collection, use, and disclosure of information that we receive through our website located at www.dcmlegal.com (the “Site”), and in connection with newsletters and other communications (collectively, the “Services”). This Privacy Policy does not address collection and use of personal information that may arise within attorney-client relationships. Such collection and use is addressed separately in our engagement agreements with our clients.

Scope  This Privacy Policy applies to all users of our Services including without limitation, all visitors to the Site, and recipients of newsletters or other communications (all such visitors and users of the Services collectively referred to as “Users”).

Personal Data  For the purposes of this policy, “personal data” refers to: your name, postal address, email address, phone number, precise location, date of birth, age, gender, and other information that could reasonably be used to identify you.

What Information We Collect

When You Visit the Site  The Firm does not collect any personal data about visitors to the Site, unless you choose to provide that information when contacting the Firm through the Site. 

Information You Voluntarily Provide  You may choose provide certain information, including Personal Data, to us, including when you contact the Firm through the Site, by email, by phone, or other means. This information may include your name, email address, phone number, the nature of your inquiry, and other information that may relate to you or identify you.

Device Information and Log Information  The company that hosts our Site (Squarespace) may collect and store certain information that your mobile device, laptop, or other hardware device sends when connecting to its servers, including but not limited to network and connectivity information, device identifiers, advertising identifiers, language preferences, user settings, software and operating system names and versions, hardware models, and IP address, time stamps, as well as other information about your use of our Services. Please refer to Squarespace’s Privacy Policy for more information. The Firm does not receive any of this Device Information or Log Information from SquareSpace, except on an aggregated basis.

Information Collected By Cookies and other Web Technologies  Our Site host (Squarespace) may utilize automated data collection tools such as Cookies and Web Beacons to collect certain information from users of our Services. These tools are used for a variety of purposes, including but not limited to user authentication, account security, delivery and measuring of advertising, analyzing site traffic and trends, and fraud prevention. Please refer to Squarespace’s Privacy Policy for more information. The Firm does not receive from SquareSpace any information derived from its use of cookies, beacons, or similar technologies, except on an aggregated basis.

How We Use the Information Our primary goals, with respect to any information we may obtain about you, are simply to respond to inquiries you may have sent to the Firm and to provide our legal and policy consulting Services to our clients. If you do choose to provide us with Personal Data, we’ll use it to correspond with you, to send relevant communications, to potentially request feedback from you, to request payments if you are a client, and to maintain our own records about clients and potential clients, We may also use Personal Data for to prevent fraud or abuse of the Services, to enforce or our agreement, Terms, or policies, or to comply with the law where required.  

Information Sharing We will not share any Personal Data that we have collected from or regarding you except as described below:

Services Providers  We may engage third-party service providers to work with us to administer and provide the Services, including but not limited to our vendors (e.g. fraud detection services, web hosting providers). These third-party services providers will have access to your Personal Data only for the purpose of performing services on our behalf. 

At Your Request  We may share information about you with third parties in the event that you request we do so, for example, if we are referring you to another attorney or service provider.

With Your Consent  There may be other circumstances where we will notify you of information that we seek to share with a third party not listed here, and will do so with your consent.

In Connection with Business Transactions  If the Firm is acquired by a third party through a merger, acquisition, or asset sale, some or all of our assets, including your Personal Data, may be disclosed or transferred to a third party acquirer in connection with the transaction.

For Our Protection or the Protection of Others  We may access, preserve, and disclose any information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity.

Your Choices  We offer you choices regarding the collection, use and sharing of your Personal Data and we’ll respect the choices you make. Please note that if you decide not to provide us with the Personal Data that we request, you may not be able to access all of the features of the Services.

Opt-Out of our Mailings  If you’ve provided your email address, we may periodically send you newsletters and emails that promote our Services. Any such email will provide instructions on how to opt out of future emails..

Modifying Your Information  You can access, modify, and request deletion of the Personal Data associated with your Account by contacting the Firm through the Site and explaining what you’d like us to do.  We’ll take steps to delete your information as soon as we can, but some information may remain in archived/backup copies for our business records or as otherwise required by law.

Responding to Do Not Track Signals  Our Site does not have the capability to respond to “Do Not Track” signals received from various web browsers.

The Security of Your Information  We take reasonable administrative, physical, and electronic measures designed to protect the information that we collect from or about you (including your Personal Data) from unauthorized access, use or disclosure. Please be aware, however, that no method of transmitting information over the Internet or storing information is completely secure. Accordingly, we cannot guarantee the absolute security of any information.

Links to Other Sites  Our Services may contain links to websites and services that are owned or operated by other parties. Information you may provide to those other parties is subject to their respective Privacy Policies, which we encourage you to read.

International Transfer  Your Personal Data may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you’re located outside the United States and choose to provide your Personal Data to us, we may transfer your Personal Data to the United States and process it there.

Supervisory Authority  If you are located in the European Economic Area or the UK and required by applicable law, you may have the right to lodge a complaint with a supervisory authority if you believe our processing of your personal information violates applicable law.

Our Policy Toward Children  Our Services are not directed to children under 13, and we do not knowingly collect Personal Data from children under 13. If we learn that we have collected Personal Data of a child under 13, we will take steps to delete such information from our files as soon as possible.

Revisions to this Privacy Policy  Any information that is collected via our Services is covered by the Privacy Policy in effect at the time such information is collected. We may revise this Privacy Policy from time to time. If we make any changes to this Privacy Policy, we’ll notify you of those changes by posting them on the Site or or by sending you a notice. We’ll also update the “Last Updated Date” above to indicate when those changes become effective.
